Description of Services: Agora Hospitals provides an online platform that allows hospitals and their departments to post job listings, including full-time, part-time, and per diem positions (referred to as "Express Jobs"). Additionally, hospitals can browse and select candidates through the platform's board of professionals, utilizing the service called "The Bid."
Account Creation: To utilize our website (agora-hospitals.com), individuals, hospitals, or authorized representatives (“Users”) must create an account. The account creation process is free of charge. Users are required to provide accurate and complete information during the registration process.
Job Postings: Hospitals are responsible for providing accurate and up-to-date information when posting job listings on the Website. Agora Hospitals reserves the right to review and approve all job postings before they are made available on the platform. Job postings must comply with all applicable laws and regulations and must not contain any misleading or fraudulent information.
Job Posting Responsibility: a. Users posting job offers on the Website must be duly authorized representatives of the hospital or entity offering the job. b. Users are solely responsible for the accuracy, legality, and truthfulness of the information provided in job postings. c. By posting a job on the Website, Users affirm that they have the authority to represent the hiring institution and that the information provided is in compliance with all applicable laws and regulations.
Verification: a. The Website reserves the right to verify the information provided by Users, including but not limited to contacting the hiring institution or individual to confirm the legitimacy of the job posting.
Consequences of Misrepresentation: a. Any misrepresentation, false information, or violation of these terms may result in the immediate removal of the job posting and the suspension or termination of the User's account. b. Legal action may be taken if it is determined that false or misleading information has been intentionally provided.
Posting Board Interaction and Contact Information Access: a. When a candidate expresses interest in a job posting on the Website, Agora, as the platform operator, will notify the respective institution about the candidate's interest. b. Institutions agree to be contacted by Agora via the email or phone number provided in the job posting.
Information Disclosure: a. Agora will disclose to the institutions, including hospitals, healthcare facilities, and their authorized representatives or individuals in charge of the recruitment or hiring process, the contact information provided by the candidate. b. Institutions acknowledge that Agora is not responsible for verifying the truthfulness of the information provided by the candidate.
Institution's Responsibility: a. It is the institution's responsibility to verify any information about the candidate before or during the hiring process. b. Agora does not endorse or guarantee the accuracy of candidate information.
Contact Information Access: a. To obtain the contact information of a candidate, institutions are required to pay a fixed fee. b. The fee is determined based on the profession of the candidate and will be outlined in the "Pricing section" of the Website.
Refundable Policies: a. The fee for accessing candidate contact information may be subject to refund under certain circumstances. b. Detailed refund policies can be found in the "Refundable Policies" section of the Website and these Terms and Conditions. c. Institutions are encouraged to review and understand the refund policies before making any payments.
“Jobtube” Overview: a. Our dedicated posting board, "Jobtube," offers a dynamic platform for Institutions to present job opportunities through a combination of written and video formats. b. Jobtube features short video presentations lasting between 50 and 90 seconds, encapsulating the key aspects and highlights of each job offer.
Video Creation Process: a. Upon posting a job offer on agora-hospitals.com, Institutions agree that Agora will generate a concise video presentation in accordance with established formats on agora-health.com. b. Agora will utilize the information provided by the Institution, including text and any additional media, to create the video. The format, images, and music will be selected by Agora. c. The video cannot be altered unless the Institution identifies a mistake that requires correction or requests removal of the job offer.
Duration of Posting: a. Agora will publish the video on agora-health.com for a period of 90 calendar days, commencing from the date the Institution is notified that the video and job post are available on the platform. b. Within this 90-day period, Agora may initiate contact with the Institution for follow-up purposes, ensuring the information remains up-to-date and the job opportunity is still available. c. If the Institution informs Agora that the job position is no longer available during this period, the post and video will be promptly removed from the platform.
Post Renewal: a. After the initial 90 days, should the Institution wish to extend the availability of their job post, they may notify Agora. b. The renewal of the post is free of charge.
Video Content and Format Changes: a. Agora reserves the right to modify the format of the videos at any time without prior notification to Institutions. b. Videos will exclusively contain part of the information provided by the Institution, along with royalty-free, generic images, and videos. c. If you authorize us, we have the option to include the logo and pictures of the institution in the video. You can indicate your agreement by checking the designated box at the end of the job posting form. It's important to clarify that no logos or specific institutional imagery will be included in the actual videos unless express permission is granted through this authorization process.
Candidate Selection ("The Bid"): Hospitals, including healthcare facilities, recruiters, or any person responsible for the recruitment or hiring process ("Institutions") may use "The Bid" mechanism to browse and select candidates from the board of professionals offering their services through the platform. The responsibility lies with the Institutions to thoroughly assess the qualifications and suitability of candidates before making any hiring decisions.
Browsing and Application Process: a. Institutions can browse through the Bids posted by professionals on the platform. b. If a particular Bid catches the interest of an Institution, they have the option to "Apply to the Bid."
Bid Application and Accessing Contact Information: a. When an Institution applies for a "Bid" of a candidate of interest and desires access to contact information, a fee is applicable. b. To obtain the contact information of the candidate associated with a specific Bid, Institutions must pay a fixed fee. c. The fee is determined based on the candidate's profession and will be outlined in the "Pricing section" of the Website. d. For added flexibility, Institutions may opt to acquire insurance concurrently with the fee payment, allowing them to seek a refund if their hiring process remains unsuccessful within 60 calendar days after Agora provides the contact information to the Institution.
Refundable Fee and Refund Policies: a. The fee for accessing candidate contact information is refundable in some cases. For more details, refer to the "Refundable Policies" section of these Terms and Conditions. b. Institutions are encouraged to review the refund policies before making any payments. c. The decision to pay the fee and express interest in a candidate lies solely with the Institution. d. Institutions acknowledge that it is their responsibility to evaluate candidates and make informed decisions based on their hiring needs.
Contact and Communication: a. By applying to a Bid and paying the associated fee, the Institution agrees to be contacted by Agora via email or phone. b. Agora may contact the Institution to provide the candidate's information or for any other necessary communication related to the candidate or the platform.
User Conduct: When using the Website, you agree not to engage in any of the following activities: i. Violating any applicable laws or regulations. ii. Using the Website for any unlawful or unauthorized purpose. iii. Interfering with or disrupting the integrity or performance of the Website. iv. Posting any content that is offensive, defamatory, or infringing on any third-party rights. v. Attempting to gain unauthorized access to any part of the Website or user accounts.
Intellectual Property: All content and materials on the Agora Hospitals Website, including but not limited to text, graphics, logos, and software, are the property of Agora Hospitals or its licensors and are protected by intellectual property laws. Users are prohibited from using, reproducing, or distributing any content from the Website without prior written consent from Agora Hospitals.
Disclaimer: Agora Hospitals strives to provide accurate and reliable information on the Website, but it does not guarantee the completeness, accuracy, or reliability of any content or information. The use of the Website and its services is at your own risk.

REFUND POLICY:
i. Fee refund procedure for access to candidate contact information when cadidates apply to a job via JobTube/Posting board:
Verification and Contact Assurance: a. Although Agora does not undertake the responsibility of verifying the veracity of information provided by candidates, we are committed to facilitating a seamless communication process between Institutions and applicants. b. Upon payment of the requisite fee by the Institution to obtain candidate contact information, Agora endeavors to ensure that the provided email and/or phone numbers are accurate to the best of our ability.
Refund Eligibility: a. If, within the initial 7 calendar days after Agora dispatches the candidate's contact information to the Institution, the latter communicates an inability to establish contact using the provided information, the Institution becomes eligible for a full refund. b. This refund, equal to 100% of the fee paid for that specific candidate, is contingent upon the Institution notifying Agora within the stipulated 7-day timeframe.
Refund Request Process: a. To initiate a refund request under these circumstances, the Institution must promptly notify Agora of the communication failure within the designated 7-day period. b. Refund requests should be submitted in writing to support@agora-hospitals.com.
Refund Processing Timeframe: a. Agora commits to expeditiously process and address refund requests under this policy. b. Refunds will be processed within 72 hours of successful verification of the communication failure. c. The time it takes for the refunded amount to be reflected in the Institution's balance is subject to the processing times of the respective bank or financial institution.
Exceptions: a. Refunds will not be granted for communication issues arising due to factors beyond Agora's control, including but not limited to candidate unavailability or technical disruptions. b. This refund is solely valid for the inability to contact the candidate within the first seven days after Agora has provided the contact information. No refund will be granted in the case of unsuccessful hiring processes.
Policy Updates: a. These refund policies are subject to periodic review and modification by Agora. b. Any changes to the refund policies will be duly communicated through the Website.
ii. Fee refund procedure for access to candidate contact information when the Institution applies to a Bid without Insurance purchase:
Verification and Contact Assurance: a. Although Agora does not undertake the responsibility of verifying the veracity of information provided by candidates, we are committed to facilitating a seamless communication process between Institutions and applicants. b. Upon payment of the requisite fee by the Institution to obtain candidate contact information, Agora endeavors to ensure that the provided email and/or phone numbers are accurate to the best of our ability.
Refund Eligibility: a. If, within the initial 7 calendar days after Agora dispatches the candidate's contact information to the Institution, the latter communicates an inability to establish contact using the provided information, the Institution becomes eligible for a full refund. b. This refund, equal to 100% of the fee paid for that specific candidate, is contingent upon the Institution notifying Agora within the stipulated 7-day timeframe. c. If the institution has purchased the insurance and is eligible for a 100% refund, Agora will also refund the payment made for the insurance.
Refund Request Process: a. To initiate a refund request under these circumstances, the Institution must promptly notify Agora of the communication failure within the designated 7-day period. b. Refund requests should be submitted in writing to support@agora-hospitals.com.

iii. Fee refund procedure for access to candidate contact information when the Institution applies to a Bid with Insurance purchase:
Bid Application and Insurance Option: a. When an Institution applies for a "Bid" of a candidate of interest and desires access to contact information, a fee is applicable. b. Additionally, Institutions have the option to purchase insurance, listed in the Pricing section of the Website, concurrently with the fee payment. c. The insurance enables Institutions to seek a refund if, within 60 days after Agora provides the candidate's contact information to the Institution, the hiring process proves unsuccessful. d. Both the purchase of insurance and communication to Agora regarding the unsuccessful hiring process within the stipulated timeframe are necessary conditions for refund eligibility.
Refund Process: a. In the event that both conditions are met and Agora determines a refund is warranted, Agora will refund 100% of the fee paid for accessing the candidate's contact information. b. The value paid for the insurance, however, is non-refundable.
Refund Processing Timeframe: a. Agora will issue the refund within the first 72 hours after confirming to the Institution that the refund will be issued. b. The time it takes for the refunded amount to be reflected in the Institution's balance is subject to the processing times of the respective bank or financial institution.
Conditions for Refund Eligibility: a. Institutions must notify Agora of the unsuccessful hiring process within 60 days post-Agora providing the candidate's contact information. b. Agora retains the discretion to assess the validity of the refund request and determine eligibility based on adherence to the specified conditions. c. Agora will confirm that the hiring process was indeed unsuccessful before the approval of the refund.
Exceptions: Refunds will not be issued if Agora confirms that the Institution provided false information about the hiring process being unsuccessful. In such cases, the refund request will not be approved nor issued.
Policy Updates: a. These refund policies are subject to periodic review and modification by Agora. b. Any changes to the refund policies will be duly communicated through the Website.
PRIVACY POLICY FOR AGORA HOSPITALS:
1. Information Collection: a. Institutional Information: Agora Hospitals collects contact details from Institutions, including but not limited to phone numbers, fax numbers, and emails, directly provided by the Institutions. b. This information is crucial for Agora to facilitate communication regarding potential candidates for job vacancies, website updates, promotional content, official communications, and any other pertinent messages deemed necessary by Agora.
2. Information Usage: a. Communication with Institutions: The collected information is utilized to establish communication with Institutions in the context of potential candidate matches for their vacant positions. b. Website Updates: Institutions may receive updates about the website, ensuring they stay informed about new features, enhancements, or changes. c. Promotional Content: Agora may use provided contact information to deliver promotional content relevant to the services offered on the agora-health.com platform. d. Official Communications: Institutions will receive official communications from Agora through the provided contact details. e. Job Offer Details: The information collected from Institutions will be displayed on agora-health.com for candidates to access and review details of job offers.
3. Information Sharing: a. Agora Hospitals may share collected information with third-party service providers or affiliates, solely for the purpose of improving services, communication, or delivering promotional content. b. Under no circumstances will Agora sell or lease Institution information to external parties for unrelated purposes.
4. Data Security: a. Agora takes reasonable measures to protect the personal information we collect and store. However, no data transmission or storage system can be guaranteed to be 100% secure. b. Institutions are encouraged to take precautions to secure sensitive information on their end.
5. Consent and Control: By providing contact information, Institutions consent to the collection and use of the information as outlined in this Privacy Policy.
6. Changes to Privacy Policy: Agora Hospitals reserves the right to modify or update this Privacy Policy at its discretion.
